Abstract

Explanation of the relationships that exist between decisions about resources, the institutions of (private) property and the protection of the environment, that is, between the economy, law and ecology. The author shows that for the use of the goods of the earth there are three frameworks of human actions that allow man to resort to natural resources for his satisfaction: the collective, community, communal or communist, which lacks regulators of the Actions; the authoritarian, state or governmental, which creates an artificial public force to regulate the use of goods with prohibitions and sanctions; and the regime compatible with the moral nature of the human being that has the incentives for success -the benefits- and the sanctions for failure -the costs-, which is the right of property. It is to the latter that experience and scientific theory give the best chance of meeting the objectives of effective protection of the environment and economic development.
